ASSIGNMENT: TO DEVELOP A STATUS REPORT ON SEXUAL AND GENDER-BASED VIOLENCE (SGBV), FORMULATE AND TRANSLATE IN SWAHILI AND GIRIAMA, STANDARD OPERATING PROCEDURES ON SGBV IN KILIFI COUNTY.
1.0 About FIDA-Kenya
The Federation of Women Lawyers (FIDA) Kenya is a non-governmental, non-partisan, non-profit making organization established in 1985 with a mission to promote women’s individual and collective power to claim their rights in all spheres of life. FIDA-Kenya is a membership organization with over 1,100 women lawyers and law students committed to the creation of a society that is free from discrimination against women in Kenya.
To address these challenges, FIDA-Kenya has two key programs; Access to Justice and Women and Governance. The Access to Justice Program focuses on providing Legal Aid, Public Interest Litigation and Alternative Dispute Resolution (ADR) in the form of Mediation as well as Psychosocial Support. The Women and Governance Program focuses on advocacy, policy engagement and transformation of formal and cultural systems to ensure that they are gender sensitive and responsive, uphold and respect women’s rights. The organization also works to combat human rights abuses and practices that perpetuate gender discrimination and sexual and gender-based violence including female genital mutilation, child marriage, rape, defilement, and intimate partner violence.
Sexual and Gender-Based Violence (SGBV) continues to be a grave concern in Kenya, with most of the victims being women and girls. According to government data, 45 percent of women and girls aged 15 to 49 have experienced physical violence, and 14 percent have experienced sexual violence. The situation has been aggravated by the COVID19 pandemic with a reported increase of defilement resulting in teenage pregnancies, FGM, intimate partner violence and femicide.
Kilifi County like the rest of the country is faced by this scourge of SGBV which affects the lives of women and girls including their socio-economic wellbeing.
The high incidences of SGBV in Kilifi and Kenya in general have been attributed to amongst others the patriarchal nature of society resulting in the subjugation of women in both the private and public spheres. Women have historically taken a secondary position to men, and this tradition is manifested in the practices, policies, and laws of the country. Cultural attitudes, poverty and low levels of education also impede women’s participation and representation in decision-making at all levels and also limits their access to economic empowerment opportunities. Women’s empowerment and the promotion of gender equality are key to achieving sustainable socio-economic development as envisaged by the Constitution of Kenya, 2010.
Despite great strides being made to ensure women’s constitutional rights are protected, women continue to experience various violations of their rights include sexual and gender-based violence.
The National Guideline on Management of Sexual in Kenya 3rd Edition, 2014 provides that comprehensive care for Sexual Violence ranges from medical treatment which includes: management of physical injuries, provision of emergency medication to reduce chances of contracting sexually transmitted infections including HIV and provision of emergency contraception to reduce chances of unwanted pregnancies. It also entails provision of psycho-social support through counseling to help survivors deal with trauma and legal assistance to assist the survivor access justice, as well as includes provision of evidentiary requirements for the criminal justice system.
The Core Competencies for GBV Program Managers and Coordinators in Humanitarian Settings describes the GBV Guiding Principles to include ensuring the safety of GBV survivor, ensuring confidentiality, respecting the GBV survivor, and practicing non-discrimination. These GBV Principles guide the development, implementation, and monitoring of GBV programs and govern protection and assistance for individuals who are survivors of violence, whether they are women or children.
FIDA-Kenya continues to advocate for the effective implementation of the provisions of Article 27 of the Constitution of Kenya, 2010 and the protection of women from all forms of violence. Low legal awareness by communities on the different forms of sexual and gender-based violence and the existing response and referral pathways have in most instances prevented timely legal action being taken against perpetrators of SGBV.
To address this, FIDA-Kenya seeks to engage a consultant or consultancy firm to spearhead the process of developing a status report on sexual and gender-based violence in Kilifi County and develop standard operating procedures on SGBV and have the procedures translated to Swahili and Giriama which are common languages at Kilifi County.
3.0 Scope of Consultancy
The consultant(s) or consultancy firm will carry out an assessment, research, collect data and prepare a status report on SGBV in Kilifi County. The consultancy firm will also work with other stakeholders in the evaluation of previous reports to come up with suitable recommendations and develop S.O.Ps for SGBV and also translate the guidelines to Swahili and Giriama languages.
The organization would like to contract the services of a suitable firm or individual to undertake this assignment.
4.0 Overall Objective of the Consultancy
The overall objective of this consultancy is to gather evidence-based information to determine the extent of sexual and gender-based violence in Kilifi County as well as measures to improve the situation and the most effective ways to handle gender-based violence cases from the time a complaint is made until the time the survivor has recovered and accessed justice.
The consultancy is also to develop a status report on SGBV as well as establishing best practices in handling SGBV to be implemented to improve the social status of women within the county and developing S.O.Ps on GBV and translating them in Swahili and Giriama.
4.1 Specific Objectives of the Consultancy
More specifically, the status report on sexual and gender-based violence in Kilifi County will:
- Identify the forms and types of Sexual and Gender Based Violence prevalent in Kilifi County.
- Examine knowledge amongst the community on the existing laws and policies addressing sexual and gender-based violence.
- Identify the challenges faced by survivors of SGBV in accessing justice.
- Gauge the effectiveness of any existing SGBV referral and response mechanisms in the county.
- Determine systems and instruments in use for accountability, evaluating and monitoring SGBV cases in the County.
- Determine the resources required and the institutions that should be established or strengthened in the implementation of SGBV related laws and policies.
- Develop Standard Operating Procedures for duty bearers and other responders who offer assistance to survivors of SGBV in Kilifi County including police, medical practitioners, counselors and lawyers with standard operating procedures on SGBV cases;
- Recommend a coordination and implementation mechanism that shall ensure effective implementation of the SOPs;
The consultant will be expected to utilize a multi-method, qualitative and quantitative participatory approach to conduct the assessment. The consultant is expected to conduct a thorough analysis of the relevant legal framework and identify the existing gaps and barriers to survivors of Gender Based Violence accessing Justice.
Questionnaires will be administered on the public and public officers in relevant departments both at the national and county levels.
The Consultant is also expected to develop an elaborate on the status of SGBV in Kilifi County.
6.0 Indicative Time Frame
It is expected that the whole task should be completed within 30 days.
The following are the deliverables:
- Inception report detailing the methodology, work plan and budget.
- Submission of all data collection tools for approval before finalizing the same for data collection.
- First draft report.
- Submission of hard and electronic copies of materials, data collected/analyzed and other gender audit documents.
- A summary PowerPoint presentation highlighting main findings and recommendations.
- Final narrative report of the research conducted detailing the process and methodology, findings, lessons learnt and key recommendations.
- Presentation of the status report on SGBV and the S.O.P guidelines on GBV in Kilifi and their translation to Swahili and Giriama.
- The consultant will have direct communication with FIDA-Kenya’s Senior Program Officer and Monitoring and Evaluation officer during the execution of this assignment.
FIDA-Kenya has allocated a budget of KES 300,000 for carrying out this service in its entirety.
9.0 Expected Profile of the Consultant
- Bachelor’s degree in Social Sciences, Law, Research or Gender Studies. (Master’s degree in the above will be an added advantage.)
- A minimum of 10 years’ experience undertaking research on human rights.
- Evidence of undertaking of similar work in the last five years.
- Excellent analytical and report writing skills.

● The technical proposal should include an interpretation of the objectives of the consultancy, detailed methodology and an elaborate work plan. Organization/individual capacity statement, past experience and activities related to the gender audit, CVs of the consulting team and their roles in the achievement of the assignment; names, addresses and telephone numbers of three professional referees.
● The financial proposal should include a detailed budget proposal; a detailed profile of the firm including contact and physical address, telephone numbers and copy of registration certificate, VAT and PIN where applicable.
